Jeff Jarvis does an admirable job breaking down the Court of Appeals decision against the FCC in his exhaustive Huff Po post: It does my democratic heart good to see the system work, as it did yesterday when an appeals court defended the First Amendment in the face of the FCC's "arbitrary and capricious" attempt to punish Fox for the fleeting expletives. The most entertaining aspect of the decision: The court agreed with the networks' defense, in part, that if George Bush and Dick Cheney can get away with saying no-no words, then why shouldn't Cher, Nicole Richie, and the rest of us? We should all have freedom of expressions as long as it's not actually sexist or racist or totally extreme.
I know of at least one case where one man's mistake of swearing on live TV in 1980/81 was used as an excuse to fire nearly the whole team of actors etc. It didnt matter that the programme went out very late at night. He only said the "f" word & he was made the scapegoat - it was a good excuse to get rid of people.
This person was never allowed to forget his mistake: ever. He committed suicide a year & half ago & I've no doubt he was pushed well over the edge by his
mistake, which he never did on purpose.
If it had happened today - no-one would've batted an eyelid......
